The candy master may have had similar words about today’s decision by Facebook’s new 20-person “Oversight Board.” For the time being at least, the silence will continue to reign, and a weary world sighs in palpable relief. “The Board has upheld Facebook’s decision on January 7, 2021, to restrict then-President Donald Trump’s access to posting content on his Facebook page and Instagram account,” the board said in a much-anticipated statement this morning. The decision surprised many, given Facebook’s rightward turn under the influence of Joel Kaplan, a former George W. Bush White House official who currently runs the social media giant’s powerful Washington, D.C. office. Time and again during the Trump administration, Facebook scrambled like a frog on a hot plate to rewire its rules in a way that made Trump’s gruesomely unacceptable proclamations palatable to the algorithms that run the site. Color me among the surprised; I would have lost a bet on this one. “Facebook has constrained its efforts against false and misleading news, adopted a policy explicitly allowing politicians to lie, and even altered its news feed algorithm to neutralize claims that it was biased against conservative publishers,” reports The Washington Post. “And as Trump grew in power, the fear of his wrath pushed Facebook into more deferential behavior toward its growing number of right-leaning users, tilting the balance of news people see on the network, according to the current and former employees.” Ultimately, Trump ran out of running room on January 6 of this year, when he went wild on Facebook as his supporters smashed their way into the Capitol building in Washington, D.C. The ban was handed down the next day. The board’s decision seemed to include a not-so-subtle scold aimed directly at Facebook owner Mark Zuckerberg: However, it was not appropriate for Facebook to impose the indeterminate and standardless penalty of indefinite suspension. Facebook’s normal penalties include removing the violating content, imposing a time-bound period of suspension, or permanently disabling the page and account. The Board insists that Facebook review this matter to determine and justify a proportionate response that is consistent with the rules that are applied to other users of its platform. Facebook must complete its review of this matter within six months of the date of this decision. The Board also made policy recommendations for Facebook to implement in developing clear, necessary, and proportionate policies that promote public safety and respect freedom of expression. For the Trump camp, at least in the six-month short term, the board’s decision is a bigly expensive deal. Beyond the immediate contact with the public provided by social media platforms, Facebook has been a dual engine for Trump: The spreading of the kind of incendiary propaganda and misinformation that is devoured by his base, combined with a massive fundraising pool. “And while GOP operatives are gaming out just what it would mean to give back the former president a powerful media bullhorn, the real impact, they say, will be seen in dollar signs,” Politico reported a day before the decision was handed down. “A return to Facebook would open major fundraising spigots that further cement Trump’s hold on the Republican Party, protecting his massive grassroots donor network from potential rivals.” As corporate titans, politicians, the media and the rest of us wrestle with the concept of free speech in the immediacy of a wired world, Donald Trump will remain mostly muzzled down in Florida for the time being. Perhaps in anticipation of the board’s decision — or maybe just to stick a nyah-nyah-I-don’t-need-you thumb in Facebook’s eye — Trump has launched what he calls a “communications platform” that will be “a place to speak freely and safely.” In fact, it’s just a basic training-wheels blog, and a pretty shabby one at that. Trump is allowed to natter on at any length he wishes; the only way for readers to speak “freely and safely” is by clicking any of the ubiquitous donation buttons. If the thing had come with the ancient AOL login sound, I would not be surprised. Reaction from the Trump camp was swift. “If you’re surprised by Facebook banning President Trump, you haven’t been paying attention,” whined former White House Chief of Staff Mark Meadows. “It’s just the latest page in the book of big tech coming after conservatives. And they won’t stop. Which means it’s past time to hold them accountable. Break them up.” The Facebook Board’s decision/non-decision adds another layer of complexity to the debate over free speech in the age of social media and the massive corporations that control them. Trump deserved to be banned for his January 6 comments, which cheered on the violent sacking of the Capitol building that resulted in multiple deaths and injuries. The issues of where to draw that line and who gets to draw it remain unresolved. The board has punted to Zuckerberg, and the possible future of online free speech now sits in his hands. This is an uncomfortable thought, to put it lightly. The limits of free speech remain among the most complicated issues in American jurisprudence, especially in the technological wonderland of the 21st century. The search for some form of standardized rules and strictures has been ongoing since the founding of the nation. In 1919, Supreme Court Justice Oliver Wendell Holmes coined the famous free speech metric, “falsely shouting fire in a crowded theater.” For decades, that has served as a simple yardstick for the limits of speech. As with all issues of speech, however, the matter is not as straightforward as it seems. The case that inspired Holmes’s iconic line, Schneck vs. United States, actually stands as one of the most viciously anti-speech decisions the court has ever handed down. Charles Schneck, a socialist, was charged with violating the 1917 Espionage Act for handing out pamphlets condemning the draft during World War I. Holmes’s “fire,” in short, was an activist protesting a war. This garbage anti-speech standard stood until it was partially overturned by the landmark Brandenberg v. Ohio decision in 1969, some 50 years later and in the middle of yet another war. Remember this the next time you see that “fire in a crowded theater” line. It sounds entirely straightforward, pithy even, yet its history is one of suppression and militaristic fearmongering. It will serve no use for the social media giants trying to figure out where to draw the line. Fire in a theater, indeed. Moreover, what we have here in the Facebook Board’s decision is a matter of ethics, and not an actual legal statement. Bluntly, nobody has a “right” to a Facebook account, and free speech laws apply as protections from state and federal actions, not corporate decisions. The board has no inherent legal power, and these questions of legality will remain in place until a court has a flesh-and-blood case it can rule on, which would set the legal precedent going forward. As corporate titans, politicians, the media and the rest of us wrestle with the concept of free speech in the immediacy of a wired world, Donald Trump will remain mostly muzzled down in Florida for the time being. This is nothing but a stupendous public good, as he has not backed off one inch from his championing of the Capitol attackers and his ruinous lies about a stolen election. Trump still largely controls the Republican Party, and has a massive civilian following at his back. Were he at the bottom of a well, he would still retain the power to blow up the news cycle if he so chose, and could raise a million dollars an hour while he was at it. The board’s decision changes none of this, and answers no larger questions. It will remain quieter around here, though, and for now that will have to do. Copyright © Truthout. More specifically, the rain forest absorbed 13.9 metric tons of carbon dioxide between 2010 and 2019 — but released 16.6 billion metric tons during that same period. (To put that in context, human fossil fuel combustion is believed to produce around 35 billion metric tons of carbon dioxide.) The authors point to poor land management policies like forest degradation as well as deforestation as causes. Notably, deforestation of the Amazon has greatly increased during the reign of Brazilian President Jair Bolsonaro. But forest degradation, as the authors write, is the primary culprit in terms of making the rainforest a carbon fount. Forest degradation happens when a forest’s biological diversity and wealth is permanently diminished. Indeed, forest degradation contributed 73% of the “gross biomass loss” of the Amazon, compared to deforestation, which contributed 27% of that loss. “Forest degradation has become the largest process driving carbon loss and should become a higher policy priority,” the authors write. Rainforests have been called the “lungs” of the Earth, and play a major role in the global carbon cycle. That the Amazon rainforest would become a net emitter of carbon was not entirely surprising given trends, however. “We half-expected it, but it is the first time that we have figures showing that the Brazilian Amazon has flipped, and is now a net emitter,” Jean-Pierre Wigneron, a co-author of the paper, told Agence France-Presse in a statement. Wigneron added, “We don’t know at what point the changeover could become irreversible.” Rainforests are not always carbon emitters. In 2009, scientists at the Climate Congress in Copenhagen, Denmark, warned that rising temperatures and droughts could transform tropical forests into being carbon emitters — rather than carbon sinks, as they were thought to have been previously. At the time, there was some hope that the world’s forests might rise to the occasion and sop up the excess carbon dioxide caused by human industrial activity. Now, that seems to not be the case, and the Climate Congress warning proved to be prophetic. This is the latest bit of bad news in a series of recent reports which raise red flags about how human industrial activity is changing the planet’s atmosphere on a mass scale. In September the World Wildlife Fund (WWF) revealed that there has been a 68 percent decline in the population sizes of “mammals, birds, amphibians, reptiles and fish” since 1970. Scientists at McGill University revealed last year that the threshold for dangerous global warming is likely to be reached between 2027 and 2042. Similarly, the World Health Organization (WHO) estimates that roughly 250,000 people will die annually because of factors related to climate change scientists between 2030 and 2050. Finally a study published last month revealed that human beings have not significantly reduced the amount of land we inhabit over the past 12,000 years, strongly suggesting that it is poor management of resources rather than the loss of “wild” lands which is causing climate change. President Joe Biden has attempted to address climate change by reentering the United States into the Paris climate agreement, beefing up environmental regulations and promising to reduce America’s greenhouse gas emissions by 50% to 52% below the country’s 2005 levels by no later than 2030. Taking a knee or lifting a fist in support of racial equality during the games would not be allowed, the IOC said. Athletes would also be barred from wearing shirts or other apparel with the phrase “Black Lives Matter” on them. Details were scant on how protests or political actions may be punished, but athletes competing in the Olympics can face punishment from one or more of three separate bodies: the IOC itself, the governing body of their specific sport, and their home country’s Olympic committee. The decision is based on the IOC reaffirming Rule 50 of the games, which restricts any type of “demonstration or political, religious or racial propaganda” by athletes at Olympic venues. “The aim of Rule 50 is to ensure that each and every athlete can experience the Olympic Games without any divisive disruption,” the IOC’s website says. The governing authority of the games based its choice to uphold Rule 50 in part on a survey it sent out to athletes and organizations, IOC Athletes’ Commission chief Kirsty Coventry explained, noting that a majority of responses were in favor of keeping the rule in place. “I would not want something to distract from my competition and take away from that,” Coventry, herself a former Olympic athlete, added. “That is how I still feel today.” Despite the survey that the IOC cited for making its decision, several sports organizations spoke out against it. Global Athlete, a progressive athlete start-up movement, took note of the survey in April and released a statement at the time decrying the idea that a person’s human rights might be determined by a vote. “One cannot survey how people feel about human rights and freedom of expression,” said Global Athlete member Caradh O’Donovan, an Irish Karate athlete and a world champion kickboxer. “These types of surveys only empower the majority when it is the minority that want and need to be heard.” Citing the Universal Declaration of Human Rights, Global Athlete added in its statement that “the Olympic podium is a media of communication to the world, and the Olympic frontier cannot be a barrier to human rights.” Responding to the IOC’s decision, Brendan Schwab, executive director of The World Players Association, said that the organization would support athletes who still planned to protest. “Any athlete sanctioned at the Tokyo Olympics will have the full backing of the World Players,” Schwab said. Some on social media accused the IOC of racism for its decision to take direct action against athletes who may have planned to highlight “Black Lives Matter” at the games. The IOC “specifically deciding that Olympians can’t wear [Black Lives Matter] attire or ‘protest’ on the podium is for what reason other than racism?” asked Shahara’Tova Dente, an English instructor at the University of Alabama, in a tweet. “Seriously needing an answer as to why that was a necessary focus when the whole Olympics was postponed because of a damn pandemic.” Color of Change, a racial justice organization, also condemned the decision by the IOC. I hope so, because it might be over. According to a report in Tuesday’s Washington Post, a cobbled clutch of “experts” from Facebook that calls itself the “Oversight Board” will soon decide whether or not to let Donald Trump back on the platform. This Board, which the Post says is “a less than one-year-old body that describes itself as an ‘experiment’ in the regulation of online speech,” will render its decision on Wednesday. Once settled, this decision will likely set the bar for what constitutes the acceptable-to-corporate-ownership boundaries of permissible free speech on social media, and will likewise be the precedent for how world leaders are treated by Facebook and other platforms going forward. There is every possibility that tomorrow will return us to the Age of Bad Noise. If the Board sides with power over common sense, Trump (along a whole lot of other tinpot autocrats) can continue polluting our minds with paranoid ranting on free social media, and the hapless press will, of course, amplify their every bent thought and twisted accusation. Why? Because, as ever, it’s good television. It is difficult to quantify the damage done by Trump’s flagrant misuse of social media platforms like Facebook and Twitter (and God help us if Twitter ever lets him back in). Here was a leader bereft of morals and out for blood, able at any moment in the day to slather the political discussion with lies, threats, complaints and vapid declarations of victory. Even now, I remember how hard it was to navigate the signal-to-noise ratio on a busy Trump Twitter day. It was like trying to collect a thought in the middle of a rock storm. The din may have felt new to us when the Trump era hit, but in one pointed way, the former president’s use of social media to confound and unhinge the national discourse is one of the oldest tricks in the book. Specifically, it is a tactic long used by fascists seeking to gain and hold power. The idea is not to debate, but to damage debate beyond repair so that even the simplest facts are open to question. In such a muddled, confused environment, fascism can flourish. What is fascism, besides being a serious word not to be bandied about lightly? Nazi fascism was its own specific ethos, outlined in excruciating detail by Adolf Hitler in Mein Kampf. In Italy, Benito Mussolini’s concept of fascism was captured in the Treccani Encyclopedia. In Spain, fascist leader Francisco Franco had his own ideas on fascist Catholicism, and fascists in the U.S. have spent decades attempting to unite their ideology with splinter Evangelical Christianity. Is there a collective definition for fascism amid all these varieties, and if so, do Donald Trump and “Trumpism” fall into that spectrum? Celebrated author Umberto Eco, himself a survivor of European fascism, endeavored to create precisely that sort of collective definition, which he called “ur-Fascism” in a 1995 essay for The New York Review of Books. Is there a collective definition for fascism, and if so, does Donald Trump and “Trumpism” fall into that spectrum? “Fascism was philosophically out of joint, but emotionally it was firmly fastened to some archetypal foundations,” he wrote. “But in spite of this fuzziness, I think it is possible to outline a list of features that are typical of what I would like to call Ur-Fascism, or Eternal Fascism. These features cannot be organized into a system; many of them contradict each other, and are also typical of other kinds of despotism or fanaticism. But it is enough that one of them be present to allow fascism to coagulate around it.” Eco fashioned 14 “features” of ur-Fascism to explain the overall phenomenon. The first of these is a fanatical adherence to tradition, something Trump used to create his entire political persona: I will bring us back to better days, when people respected and honored all the things you believe in. The second feature is a rejection of modernism, which again has become a staple of current Republican groupthink. This new world is happening too fast, too many people are getting rights they shouldn’t have. Modernism is the death of tradition, a fact Trump has used to great effect. The third feature, irrationalism, preaches action for action’s sake, thoughtless, heedless, bereft of self-awareness. “Action being beautiful in itself, it must be taken before, or without, any previous reflection,” writes Eco. “Thinking is a form of emasculation.” Heedless action on social media: Who does that sound like? The fourth feature is the complete dismissal of analytical criticism. One does not question the leader, the party, or the actions that have been taken. “For ur-Fascism,” writes Eco, “disagreement is treason.” That line may as well have been at the top of the 2020 Republican platform, had they bothered to make one. The fifth feature is a radical hatred of diversity. Fascism requires rigid adherence to a basic way of being, a code, a slate of honored traditions. Outsiders are to be feared and shunned in the quest to create a perfectly homogenized society. “Thus,” writes Eco, “Fascism is racist by definition.” See: Trump’s border and immigration policies. The sixth feature states that ur-Fascism derives its power from individual or social frustration. This, perhaps more than the others, is the hallmark of Trumpism, the iron spine of its power and influence. Millions of people who feel left behind in this rapidly changing world grapple with fear and fury, and Trump taps that aquifer with a deftly swung sledgehammer. Six features in, and we have checked every box with a heavy marker. The other features — loud nationalism, jealousy of the enemy, a permanent state of conflict, disdain for elites and elitism, the championing of the masculine, a populism that preaches rights only for the righteous few, and the creation of a new vocabulary that stifles complex and critical reasoning — are all straight out of the Trumpian playbook. Umberto Eco seems to have seen Donald Trump coming for 20 years. If Trump is allowed back on Facebook, he will again pursue an aggressive campaign of chaos aimed at disrupting the essential workings of democracy to his own ends, and he already has a devoted mass following. The Facebook “Board” should let the silence rule a while longer. Trump and his followers aren’t here to talk, or to share, or even to lead. They are here to break things, as evidenced on January 6. It has been described as an unflinching narrative of genocide and exploitation, beginning with the colonizing of Indigenous land that is now called the United States. The documentary series seeks to counter “the type of lies, the type of propaganda, the type of abuse, that we have been subject to all of these years,” says director and Haitian-born filmmaker Raoul Peck. “We have the means to tell the real story, and that’s exactly what I decided to do,” Peck says. “Everything is on the table, has been on the table for a long time, except that it was in little bits everywhere.… We lost the wider perspective.” TRANSCRIPT This is a rush transcript. AMY GOODMAN: Republican lawmakers are continuing their attack on schools for teaching students about the true history of the United States, from the genocide of Native Americans to the legacy of slavery. Last week, Senate Minority Leader Mitch McConnell wrote a letter to Education Secretary Miguel Cardona criticizing what he described as the Department’s promotion of revisionist history including The New York Times 1619 Project, which reexamined the pivotal role slavery played in the founding of the United States. In his letter, McConnell wrote, “Americans never decided our children should be taught that our country is inherently evil,” he said. New York Times reporter Nikole Hannah Jones, who created the 1619 Project, responded by saying ” “Republicans across the U.S. are pushing laws to mandate ‘patriotic’ education & to prohibit the teaching of the #1619Project and about the nation’s racist past.” Well, today, we spend the hour looking at an epic new series that delves deeply into the legacy of European colonialism from the Americas to Africa. The documentary is titled Exterminate All the Brutes. It’s directed by the Haitian filmmaker Raoul Peck. It has been described as an unflinching narrative of genocide and exploitation, beginning with the colonizing of indigenous American land. This is the documentary’s trailer. RAOUL PECK: There is the story we have been told. In Columbus’ travel journal, they were discovered. But there is no such thing as alternative facts. There is something we need to talk about. Three words that summarize the whole history of humanity. Civilization, colonization, extermination. This is the origin of the ideology of white supremacy. This is me in the middle, and I just want to understand, why do I bring myself into this story? Because I am in immigrant from a [beep] country. Neutrality is not an option. It’s time to own up to a basic truth. The story of survival and violence. We know now what their task truly is. Exterminate all the brutes. It is not knowledge we lack. We already know enough. What is missing is the courage to understand what we know. Who are we? What if from the beginning the story was told the wrong way? The nightmare is buried deep in our consciousness, so deep that we do not recognize it. And over the centuries, we lost all bearings. Because the past has a future we never expect. Raoul Peck, it is great to have you back on Democracy Now! This is an epic masterpiece, this four one-hour documentary series. Can you talk about how you went from I Am Not Your Negro, which was the story of James Baldwin, to creating this masterpiece? RAOUL PECK: Well, basically after I Am Not Your Negro, I went throughout the world with the film. I was fortunate to be able to see how the film was received in many different places. And one of the common threads through that was the type of reaction that you just mentioned, like Senate Leader Mitch McConnell. This denial is somehow a sign that they feel that they are entrenched now, they are attacked. There is great fear about some sort of civilization going overboard. And for me it is a symbol that the type of lies, the type of propaganda, the type of abuse that we have been subject to during all these years. I am old enough to have heard many other people like Rick Santorum and Mitch McConnell and many others throughout the years. The only difference now is that we have the means to counter them. We have the means to tell the real story. And that is exactly what I decided to do, to once and for all put everything on the table without any semblance of holding back my punches. Everything is on the table and have been on the table for a long time, except that it was in little bits everywhere. Because science, sociology, anthropology, et cetera, politics, have been cut up in little pieces, so we lost the wider perspective. And the film does exactly that, to bring us to the core story, to have the whole matrix of the last 700 years of basically Eurocentric ideology and narrative. NERMEEN SHAIKH: Raoul Peck, in providing this broader historical context, you trace the origin of contemporary modern forms of biological racism to the Spanish Inquisition and the so-called purity of blood statutes — that is limpieza de sangre — that was a means of distinguishing old Christians from conversos, that is Jews but also Moors, from the pure blood of Christians. These laws, you say, are the antecedents of the ideology of white supremacy. For the first time in the world, the idea of race based on blood was enshrined into law. So how should we understand the continuities between the purity of blood statutes and the forms of racist violence we witness today? Because the entire argument of this truly magnificent work is that the past is not really past. It is, as you say, the past has a future that we can’t anticipate. RAOUL PECK: Well, the thing is that we are accustomed to not see history as a continuity, as you say. And we came from a very specific history. We are not some sort of tribalist tribe that came out of nowhere. Today’s civilization is basically embedded in the capitalistic societies. And that story started around the 10th and 11th century with the first accumulation of riches, accompanied by the killing and exiling of Jews, killing Muslims, trying to go all the way to Jerusalem. Those first Crusades were able to create a lot of — or not create, to basically extract a lot of riches that allows the monarchy to be able to finance trips to discovering new roads to the east. And the accident, which it was, of the so-called discovery of the new continent was not something they planned. And when it happened, they basically created a totally new concept, which is the concept of discovery. And from that day on, you could just go somewhere, put a flag, deploy military [INAUDIBLE] and say, “This is mine,” no matter who was on the land before. And I remind you that at the time of Columbus, there were basically 100 million people on both continents in America. So you can imagine what it meant. Within 100 years, more than 90% of them were totally annihilated. So it is a very specific moment in the history of the modern world. For the U.S., it seems like it’s the beginning of a new world, but it’s not. It’s a continuity of a lot of action that have been the source of European civilization, basically. AMY GOODMAN: Let’s go to a clip from Exterminate All the Brutes, where you explain settler colonialism. RAOUL PECK: From the beginning, the extension of the United States from sea to shining sea was the intention and design of the country’s founders. Free land was a magnet that attracted European settlers. This particular form of colonialism is called settler colonialism. But as a system, it requires violence. It requires the elimination of the natives and their replacement by European settlers. AMY GOODMAN: And this is another clip from your series Exterminate All the Brutes. In this dramatized scene, a white man, played by the actor Josh Hartnett, engages in a standoff with a Native American woman leader. WHITE MAN: I do not want to spill Seminole blood, kill Seminole children, Seminole women. Give us back the American property you stole from our good fellowman planters and settlers and I will let you move to the Injun territory the U.S. government has provided for your people. NATIVE AMERICAN LEADER: You call human beings your property? WHITE MAN: They’re slaves. NATIVE AMERICAN LEADER: You steal land. You steal life. You steal humans. What kind of species are you? AMY GOODMAN: We were listening to Abi Osceola [sp] or the woman who plays her, of the Seminole nation. You say her story goes deep into the history of this continent. Talk about who she is and why you choose to center her and the Seminole Nation in the first part of your series, including their solidarity with enslaved Africans. RAOUL PECK: Well, the whole vision of the film is based in changing totally the point of view of who is telling the story. And in particular because this story not only center from Europe but also center in the bottom or in the middle of the United States of America, I had to start the film from that particular point of view of this woman who is the head of her tribe, of her nation. And basically the Seminole have been one of the rare tribes who were never really — who did not really obey to the enforcement of leaving their territories. They were called the Invisible Tribe for a reason. So it was important for me to start it from a point of resistance, from a point of an individual, of a woman. And watching this invader basically telling her to leave her land and to deliver the slaves that were — and of course, that’s a story that is not really well-known, that a lot of slaves who escaped were welcomed by Seminoles and other tribes. And I wanted to start with that symbolic moment of resistance and also of solidarity, and from there, deploy the whole rest of the story. NERMEEN SHAIKH: Raoul, that is in one of the forms of continuity that you point to. The story of Native Americans is absolutely critical and the erasure of this genocidal history, in particular in the United States, is evidenced, as you show, in the perverse use of Native American names and designations for military weapons from Blackhawk to Apache, as well as military operations, the most recent and proximate of which was the May 2011 operation named Geronimo to assassinate Osama bin Laden. So could you talk a little bit more about that, the way in which Native American history has been distorted, if not entirely erased, and the uses to which it has been put in contemporary U.S. politics? RAOUL PECK: Well, it is clear that — and you see that throughout the film through different type of device or type of stories, level of stories in the film, is how everything is somehow connected. The history of the Native American, which is for me the core story, whether it has been pushed out and erased sometimes or told the wrong way, it is like a phantom. It is already there. You can’t get rid of it. There are so many skeletons in those boxes, that they come up. And they are more and more coming out. And it’s ironic that the very powerful U.S. Army who was basically at its core created not only to fight the British at the beginning but after independence was basically used to kill Indians and to keep Black slaves on the plantations. So basically, the U.S. Army at the beginning was the militia. So this story continues. It is basically a story of 200 years, which in the whole history of humankind is nothing. So as long — you can try to repress that story, but it is coming out there. As long as there will be Native American or there will be Black life, they will continue to tell that story. There is no escape from it. And that’s why what I was saying at the beginning — when you see people like Rick Santorum saying that, “Well, when we came, there was nobody on this land” — what did you do with the 100 million people? You have to explain that. So it becomes more and more absurd that Republican leadership at that level are capable of such ignorance. It’s mind-bending [sp]. So for me, it is just the logic of the whole story. And that is what we try to explain and to tell in this story of Exterminate All the Brutes. My objective is really to make sure that that kind of ignorance cannot be voiced anymore. NERMEEN SHAIKH: Raoul, another possible form of repression, another idea that has been repressed, is something that Sven Lindqvist in his extraordinary book Exterminate All the Brutes, from which your film substantially draws, he shows how closely intertwined the idea of progress is with racism and even genocide. And in the film, you explain Darwin’s central if unintended role in providing scientific validation for racial prejudice and hierarchies with his notion of natural selection, saying in fact that genocide came to be regarded as the inevitable byproduct of progress. You show in the film as well the iconic late 19th-century painting by John Gast titled American Progress. But of course, this idea of progress remains central to the way in which global society and American society are organized. What alternatives do you see to this ideology, and where do you see it, if at all, taking shape? RAOUL PECK: Well, it is a very complicated question to answer. And I don’t really go by that way in assessing what the future will be or what are the solution. I think any solution will first have to start with the real story. We need to sit down around the same table and agree on the diagnostic. We have to agree on the genocide. We have to agree in the whole line of history that has been going on for more than 700 years. Otherwise, there is no conversation possible. So I am not and we are not, if I can speak for many others, it is not about revenge. It is about let’s see the world as it is and let’s name all of the things that happened and bring us to what the world is today. That is what it is about. It is not about showing how culprit you are or not. It is about acknowledging the past and the present because they are strongly connected. So for me, it’s the same thing as democracy. As long as we accept democracy as our mode of communication, if we want to come out of that situation, it is implied that we have to sit down and have a real conversation, an honest conversation. But unfortunately, we see that the dominant narrative is not ready for that. They’re totally with the back on the wall and can’t let go of their huge inequality that is actually in those last 30, 40 years that have never been as extreme as it is. January 6th is also another sign of a democracy which is in a dire situation, that this country which had been seen as the forefront of democracy and justice was able to attack the very center of that democracy. So the confusion is just huge. And it is difficult for me to acknowledge any type of solution. I think the solution should come from us, from all of us, and a collective decision. That is the only vision I can have. AMY GOODMAN: We’re talking to Raoul Peck, the acclaimed Haitian-born filmmaker who then grew up in the Democratic Republic of Congo as well as the United States. I want to go to another clip from the second episode in the series, where Raoul Peck — he is the narrator of this series — explains what happened after Columbus arrived in what is now Haiti, where Raoul Peck was born. RAOUL PECK: Instead of the bustling ports of the East Indies, Columbus came upon a tropical paradise populated by the Taíno people, what is now Haiti. Then from the Iberian Peninsula came merchants, mercenaries, criminals and peasants. They seized the land and property of indigenous peoples and declared the territories to be extensions of the Spanish and Portuguese states. These acts were confirmed by the monarchies and endorsed by the papal authority of the Roman Catholic Church. That’s more or less the official story. And through that official story, a new vision of the world was created, the doctrine of discovery. AMY GOODMAN: That’s a clip from Exterminate All the Brutes, the 18th century known as the Age of Revolutions. But we often associate this time with the American Revolution or the French Revolution, not the Haitian Revolution, which was led by Black slaves, the first country in the Western Hemisphere to be born of a slave uprising. You say, Raoul Peck, the only revolution that materialized the idea of enlightenment, freedom, fraternity, and equality for all. Haiti becomes a republic and the U.S. Congress would not recognize it for decades, fearful that the fact that Haiti was born of a slave uprising would inspire the enslaved people of the United States to rise up as well. Can you talk about the erasure of the Haitian Revolution, your own country, Haiti, its significance for you, and how the U.S. dealt with Haiti all of these years? RAOUL PECK: The best words for this is what Michel-Rolph Trouillot have written about silencing the past. It was key for the U.S. and all the other European powers to silence the Haitian Revolution because it was in their eyes worse than Cuba in the 1950s. We were under a strict embargo because all of them had economy that still relied on slavery. And Haiti was the worst example they could have. And Haiti was also beating them in terms of their own ideology of enlightenment, because Haiti, the first constitution of Haiti, basically stated any man or woman or person who set foot on the island is a free person. And none of the other revolutions dared go so far, because they were totally involved in slavery and were profiting from it. So there was no way the Haitian Revolution could be accepted. So when people say that America is the first democratic country in the Western Hemisphere, it is not. It is Haiti. And the story continue until today. We have a history of being attacked, of being invaded, of many of our leaders come to power with the acceptance of the U.S. government. And it continue until today. Basically, the last two presidents we had came into power thanks to the support of the U.S. government. So we are unfortunately a long story of abuse from the United States and also of resistance. Because one thing that we can say is that the Haitian people were always, whether it take 30 years, five years, or two years, they always make sure that they can get rid of those corrupt leaders. NERMEEN SHAIKH: I want to ask about one of the critical issues that you raise in the last part of the film, a critical question. You talk about your own experience living in Berlin where you lived for 15 years and were also a film student, where you made a film on a Nazi torture compound. You say when you were there that you thought a lot about how a country that has produced some of humanity’s best philosophers, scientists and artists also operated one of the most devastating scientifically run and engineered killing machines. Now, many people have reflected on this question and the seeming contradiction in this fact by concluding that the Holocaust was some kind of historical aberration. In other words, that it stands very much outside the history of the Enlightenment and the ideas of humanism and universalism on which it apparently stands. But even as this is raised as a question, your film suggests that other conclusions could be drawn. Could you talk a little bit about that? RAOUL PECK: Well, it’s nothing new. In fact, there are many scholars that have worked on that specific question for the last 50, 60 years. And of course there is resistance to say that the Holocaust was a very special moment in the life of Western civilization. But it’s not. It’s a continuity of a will [sp] of genocide, the will [sp] of eliminate people that are deemed inferior. The structure of genocide are always the same. The person who invented the word “genocide” in 1943, Raphael Lemkin — we went to the New York Public Library, and in that library, in his file, there is a list of something around 42 previous genocides before the Holocaust. And he include in it of course the genocide against the Native American people. So trying to make any type of genocide special I think is a really not correct way of seeing the history of humankind. They all copied from each other. They are all of course specific. You can’t directly compare the genocide in Rwanda with the genocide in Cambodia and with the Holocaust. They have different ideological reason. They have different historical reason. They have different people involved. But as the structure, as the system of genocide, they all obey the same pattern of first pinning down a special category of person, of people, and then start saying that we are superior to them, and they are insect. And as soon as you come to the point where they are animals or they are savages, or they are insect, you are allowed to kill them. And that is the excuse that was always needed for every imperialist, for every conqueror in order to eliminate whoever was in the land they wanted to conquer. So it’s similar. It happened similar throughout the history of humankind. And it became more specific within the concept of the capitalistic society because then it was also linked to profit. It was also linked to make bigger territories in order to exploit large communities. So I have had that discussion many years ago, back ago, including in Germany. But today, I think we should move past that what I would call the confrontation between who got the biggest pain. Do we put slavery confronted to the Holocaust or the [INAUDIBLE] pain? It is not about that. We are all from the same human family. It is not about who has suffered more. I think we have to acknowledge every piece of history that happened on this planet, and we have to give responses to them. And we have to explain why they happened. Because it is the only way that eventually we can prevent them to happen again and again. AMY GOODMAN: We want to talk more about that after this last clip from the series Exterminate All the Brutes. RAOUL PECK: Trading human beings, what sick mind thought of this first? Brought by force and pushed to death — slavery, or the trade, as they they referred to it euphemistically. A state-sponsored genocide. What does this say about the civilized world? AMY GOODMAN: So if you could talk more about what this does say, and going back to the beginning, talking about genocide, the term coined by Raphael Lemkin, colonization, as well as civilization, and how you find hope today in the discussions, if this is all acknowledged, though you are saying just acknowledging this is not enough. RAOUL PECK: Yes. Of course. But acknowledging it is a big step, and that is what I wanted to say before, is that even for me as a filmmaker, telling that story, it took a lot of thinking in order to tell a story where for the first time you tell the story of the genocide of Native American and then you tell the story of slavery and then you tell also one of the major extermination story, which is the Holocaust. And for the first time I think, at least on film, you can see the connections between them. And for me, it is a huge step. It is taking all those atrocity in a different context. And for me, it can only be the beginning of a wider conversation. Instead of each part keeping their own [INAUDIBLE], keeping their own death, their own pain, and sometimes being used against each other, you know? And that is a divide that has been used for many, many years. For me, the film is also a step to break that separate narrative. There is not many different stories. There is one historical knowledge. And we need to access it. And to your question, that’s the [INAUDIBLE] in the series. We already know enough. The problem is, what do we do with that knowledge? Because everything I say in the film, everything that Sven Lindqvist tells the story about, or Michel-Rolph Trouillot, or Roxanne Dunbar-Ortiz, those are fact. Those are highly competent scholars who spent their life documenting the horror. And my use of their work with them was exactly that, to force the conversation to a more sovereign [sp] type of discussion and to push aside the blurring of history, push aside the ignorance that still reign in the discussion. I’m not going to name them again, the two politicians I named, but I think the population are more and more interested in learning where they come from. There’s a reason why everybody now wants to have their DNA analyzed. Because there is some sort of feeling of connection, you know? And it’s our job as filmmakers and U.S. journalists as well to lay that in plain sight. And then we can say, “Okay, what do we do with this?” NERMEEN SHAIKH: That’s exactly — we just have a minute. What do we do with this? Your film begins and ends with the same line that Sven Lindqvist says again and again-”It’s not knowledge that we lack. What is missing is the courage to understand what we know and draw the conclusions.” How does your film and the work of these other authors enable that courage? RAOUL PECK: I was primarily educated by Jesuit. [laughs] And one thing, maybe from that, that I believe in the notion of knowledge. I believe in the notion of learning the truth. And the film for me is the first step. My wish is that every school, every university is able to watch the film and have discussion around it. Because you cannot go further if you don’t know your own history, whatever the side you are on. But you need to know. It is not about accusing you of anything. It’s about facing your reality. Because you can’t understand what is going on. You can’t understand why policeman are still killing Black kids and Black men and Black women in this country if you don’t know where it comes from. And it’s unfortunate, we are in a time where we have a huge instrument for communication, and huge instrument for learning. You can go on the Internet and learn about everything. But we lack a very condensed matrix of those histories that we have been built by. And each one of us needs to do our homework, otherwise I don’t see any nonviolent outcome out of this. AMY GOODMAN: Well, you have given us a remarkable assignment and an epic work to watch for all. Republican legislators in the state, who hold a majority in the legislature, successfully subpoenaed 2.1 million ballots earlier this year. Senate Republicans demanded the ballots from election officials in Maricopa County, which put Biden over the top and then didn’t have anywhere to put the ballots once they got them. The GOP obtained the ballots with the goal of completing their own audit of the election results, despite the fact that the state’s own audits, as well as Maricopa County’s audit, found no evidence of voter fraud. Still, Republicans think that they can conduct a better audit — perhaps one with different results — and have hired a company with zero experience with elections to do so. As Judd Legum of Popular Information wrote, “The counting will continue until results improve.” The company Republicans have hired, for $150,000 of taxpayer money, is called Cyber Ninjas. Cyber Ninjas is a Florida-based cybersecurity company which has been described by its founder, Doug Logan, as a “Christian company.” Logan has espoused views supporting the conspiracy theories put forth by “Stop the Steal” groups and QAnon-affiliated Ron Watkins, who propagate the false claim that it was former President Donald Trump, not Biden, who truly won the election. Arizona is not Logan’s first rodeo in challenging election results. He was previously listed as an expert witness in a lawsuit in Michigan where the plaintiffs claimed that voting machines were rigged. Though the company has tried keeping their audit methodology under wraps, they’ve been ordered by a judge to disclose documents with procedures for the audit. The procedures “[don’t] make any sense, and I’ve seen a lot of audits,” Tammy Patrick, senior elections adviser for Democracy Fund and former Maricopa County elections worker, told USA Today. The documents detailing procedures for “forensics” are vague and unclear. One such procedure evidently being employed by Cyber Ninja is using UV lights to check for watermarks on the ballots. Arizona’s ballots don’t have watermarks, and the Brennan Center for Justice has warned that the lights could make the ballots deteriorate, but that hasn’t stopped conspiracy theorists from believing that using the UV light might reveal a secret watermark. Observers and election experts have also caught the auditors making basic mistakes like using blue pens that might alter the vote on a ballot or not securing the area where ballots are being counted by locking the doors. Cyber Ninjas has also recruited former state lawmaker Anthony Kern to help validate ballots. Kern is a Trump supporter who was at the Capitol on January 6 with the mob trying to get the election results overturned. State Republicans are also evidently trying to raise funds beyond the $150,000 from the government for the audit effort, Legum reports. The Arizona Senate is soliciting donations to raise $2.8 million for the effort on a website, fundtheaudit.com, owned by an organization created by former Overstock.com CEO Patrick Byrne, also a known Trump supporter. Trump himself has been bragging about the audit, despite the fact that Arizona lawmakers don’t have the authority to overturn election results. Still, he’s been telling Mar-a-Lago guests that the audit will perhaps help reinstate him — although, even if the legislators could overturn the result of the state’s election, and if there were any evidence of fraud, the 11 electoral votes it would give the former president would still not be enough to give him the win he wants. So then why are Republicans still chugging along to overturn Arizona’s results? It’s unclear, but the audit is already likely having harmful effects. Most Republican voters still believe that the election was rigged; and the very fact that Republicans are conducting an audit may indicate, to some, that there are legitimate reasons to believe that there was fraud, no matter how spurious the real reasons for the audit are. Political observers warn that the results of the audit, even if they’re falsified or based on flawed methodology, could end up adding fuel to the Republicans’ voter suppression fire in Arizona and across the country. “The idea, obviously, is to create a new truth for Republicans,” wrote MSNBC’s Steve Benen, “at which point pro-Trump forces can exploit the lie to justify new voter-suppression efforts and perhaps even related efforts in other states, where Republicans can hire Cyber Ninjas of their own.” Copyright © Truthout. The legislation, which sets aside funding for underserved communities, now goes to the House for consideration. The Drinking Water and Wastewater Infrastructure Act (DWWIA) allows for gradual increases in state funding for water infrastructure programs from 2022 to 2026. It nearly doubles funding for lead removal projects, including removing lead pipes from schools, and allows for over 40 percent of funds to go toward helping underserved and tribal communities. It also promotes investments in projects to improve water infrastructure to be more resilient to the effects of the climate crisis. The legislation passed the Senate 89-2. The two no votes were cast by Senators Mike Lee (R-Utah) and Ted Cruz (R-Texas). Proponents of the bill say that the bill is desperately needed to improve water infrastructure in the U.S. “To truly ‘Build Back Better,’ our nation must prioritize putting Americans back to work repairing and upgrading the aging pipes we all depend on to deliver our water,” said Sen. Tammy Duckworth (D-Illinois), lead author of the bill. “Years of failure to make adequate investments in our water infrastructure has led to a status quo where millions of Americans are served their drinking water through what is essentially a lead straw.” Water infrastructure in the U.S. is indeed in need of improvement. In their 2021 infrastructure report, the American Society of Civil Engineers (ASCE) gave drinking water infrastructure in the U.S. a C minus, saying that “the system is aging and underfunded.” Investment in water infrastructure in the U.S. has seen a dramatic decline in the last four decades. A 2020 study by the ASCE found that the investment gap for drinking water and wastewater would grow to $434 billion by 2029 if left unchecked. This is particularly an issue for poor and minority communities. Studies have shown that the problem of a lack of access to clean drinking water — like the still-ongoing water crisis in Flint, Michigan — is most often experienced by poor communities with large nonwhite populations. A 2019 study by the National Resources Defense Council found that water systems that continually violated the laws on clean drinking water were 40 percent more likely to be located in communities with a high proportion of residents of color. Wide support for the DWWIA in the Senate indicates that there is bipartisan support for infrastructure investments — a topic du jour, thanks to President Joe Biden’s recent infrastructure proposals. Biden’s infrastructure bill also includes a proposal to replace all lead pipes among many other infrastructure improvements, but Republicans have aligned themselves against it. The DWWIA might be a welcome step toward repairing the country’s water systems, but some environmental advocates say that it still won’t be sufficient to address issues of years of racist policies that have long disadvantaged nonwhite communities. “While this legislation is a great start, it cannot be the final investment in communities that have been in peril even before the COVID-19 pandemic further devastated them,” said Julian Gonzalez, legislative counsel for Earthjustice, in a statement. “We look forward to Congress continuing to act through a larger infrastructure package, with significantly more robust funding for removal of lead service lines, more grants to disadvantaged communities and tribal nations, and more funding for ratepayer assistance.” Copyright © Truthout. A new poll says that most of us are optimistic about the country’s future (with a margin of error of plus or minus eleventy billion, of course). According to ABC News/Ipsos, a full 64 percent of the country believes we are on the right track. It makes sense: The president of the United States is no longer screaming 20 hours a day about whatever happens to pass his screen. New COVID-19 infections are down by almost a quarter, and the number of COVID deaths has also dropped. Close to half the country has been at least partially vaccinated. The weather is turning, and opportunities for outdoor activities are expanding.

Multiple national organizations, including Scholars for Social Justice and the American Studies Association, have endorsed the call for college and university campuses to join the national “Cops Off Campus” May 3, 2021, “Day of Refusal” and to organize with each other to contribute to solidarity activities throughout “Abolition May.” In addition to more than 30 University of California and California State University campuses, colleges and universities across the continent are participating in this month-long mobilization, including the University of Illinois, the University of Chicago, the City College of San Francisco, the University of Texas, Yale University, San Bernardino Valley College, the University of Virginia, the City University of New York, Johns Hopkins University and the University of Pennsylvania. The May 3 Day of Refusal is a one-day commitment to withdraw all labor and participation from college and university activities, including (virtual) classes, events/webinars, email correspondence and administrative meetings. This is the inaugural mobilization of Abolition May, which Cops Off Campus conceives as an open invitation to organize and participate in a wide variety of community-building actions, including abolitionist teach-ins, mutual aid drives for vulnerable people on and near campuses, autonomously organized town halls, banner postings, street theater, walking tours focusing on sites of past police and university violence, and the creation of memorials commemorating people killed by police. As this movement unfolds, the University of California (UC) administration is actively engaged in a repressive and reactionary response to the crises shaping the current historical moment. A series of proposed revisions to the systemwide UC police policy will expand the capacity for statewide police militarization (via “Systemwide Response Teams”), enhance UC Police Department (UCPD) surveillance technologies (by distributing body-worn cameras), and further weaponize the UCPD’s “Use of Force” policies. The implications of this administrative proposal are deeply concerning, not only because UC is among the largest public university systems in the world, but also because it has historically served as an experimental ground for the development of modern police technologies and protocols. Students, faculty, staff and surrounding communities are identifying and confronting the UC administration’s approach to police reform through vigorous abolitionist organizing. Central to this work is the embrace of rigorous shared analysis, education and planning that fundamentally challenge the institutional assumptions underlying police-dependent notions of campus safety. Alongside UC Student Association leader (and UC Riverside student) Naomi Waters, San Francisco State University student leader Ja’Corey Bowens and Laney College professor Kimberly King, I participated in the presentation of a clear abolitionist response to the ongoing problem of university and college police presence during the April 21 CalMatters/KQED (Los Angeles) event, “The Future of Campus Policing.” During this discussion, the four of us collectively reframed notions of “safety” and “security” by centering dynamic, decriminalizing, community-accountable infrastructures that deprovincialize college and university campuses, emphasizing how institutions like UC have historically had gentrifying, disastrously criminalizing effects on surrounding people and geographies. The resulting debate with the UC Regents Chair John Perez and UC Davis Police Chief Joseph Farrow exemplified the recent and remarkable shift in the content and parameters of critical public discussions of police power. Such debates are increasingly engaging with abolitionist frameworks and thus no longer accept the severe limitations of reformist scripts. While the impact of such invigorated debates on the UC administration’s policing policy is still to be determined, it seems clear that the campus police presence is steadily losing credibility. The administrative leadership can no longer presume consent to its definition of “campus safety.” Abolitionist security and safety measures directly confront and address the insecurities — housing, food, health, economic, and otherwise — that are not only created and reproduced by colleges and universities, but are also reinforced by their policed relation to surrounding (working-class and poor, unhoused, Black, Indigenous, Brown, undocumented, criminalized) communities. In contrast to this dynamic abolitionist approach, the UC administration proposes to reform, expand and further militarize its police force in the name of safety, peace and security. Three aspects of its plan are worth special attention, especially as they are likely to influence other institutions’ approaches to police reform: the creation of Systemwide Response Teams, deployment of body-worn cameras, and preemptive sanction of police violence and intimidation through enhanced use-of-force policies. On “Systemwide Response Teams (SRTs)” The “MISSION STATEMENT” of SRTs states, 1602. The mission of the University of California SRT is to maintain a trained team of sworn personnel with the skills and equipment readily available to assist local campuses to: (a) Facilitate and protect the Constitutional Rights of all persons; (b) Keep the peace and protect life and property; (c) Protect lawful activity while identifying and isolating unlawful behavior; (d) Provide dignitary protection; and (e) Provide training and other assistance when requested and appropriate. It is a shock to the conscience and ethical sensibility of many UC students, educators and workers that, after a year of worldwide uprisings against police violence, the UC administration is proposing the creation of a new, specialized police force that significantly expands the power, militarization and personnel of the existing UCPD. The SRT apparatus facilitates multicampus police mobilizations for the purpose of controlling and suppressing mass demonstrations on and near UC campuses. By way of example, the provisions cited above would allow (if not obligate) the UCPD to convene SRTs for the purposes of deterring, repressing, and/or neutralizing public protests of UC Regents’ meetings, while utilizing SRTs as a privileged form of paramilitary protection for visiting “dignitaries” (e.g. ambassadors and prominent state officials) representing governments that may be widely criticized for historical and ongoing atrocities, including apartheid, colonial occupation and genocidal violence. (This provision seems especially well-suited for targeting mobilizations of solidarity with Palestinian liberation that challenge the policies and asymmetrical violence of the Israeli state.) The paramilitary nature of the SRTs is crystallized in the proposed policy’s provision for the assignment of special personnel “to meet operational needs,” including “grenadiers.” According to the U.S. Army’s “Infantry Rifle Platoon and Squad” Field Manual, a grenadier is a soldier equipped with a grenade launcher for the purpose of “providing limited high-angle fire over ‘dead space.’” According to the University of Wisconsin police, the grenadier is an officer who has been trained in the use of “Chemical Agents/Munitions and their delivery systems.” Notably, the UC policy does not provide a clear definition of this personnel category, and the grenadier’s capacity to engage in tactics of campus-based counterinsurgency is left to speculation. On “Body Worn Audio/Video Systems (BWVs)” The proposed revision to UC police policy allows UCPD officers extraordinarily wide latitude to exercise “discretionary activation” when it comes to use of their body-worn video cameras (BWVs). They are given enough room for subjective interpretation of situations that they can essentially activate or deactivate their cameras anytime they wish, with rather loose requirements for post facto justification. Further, there is no clear consequence for failing to activate (or unjustifiably deactivating) BWVs, and there are also no apparent consequences for losing or “accidentally” erasing the BWV footage itself. By way of example, “1520. Modification, Alteration, or Deletion” states, “no employee shall modify, alter, or delete video or audio once recorded by the [body-worn] camera, except as authorized by Department policy,” yet there is no accompanying clarification of penalties if the policy is violated. Such toothless and deceiving policies effectively create superficial, bureaucratic approaches to “police accountability” that serve to expand the technology and judicial impunity of policing. Use of force protocols neither prevent nor curb anti-Black, racist, gendered and ableist police violence. It is well established that even when used according to prescribed guidelines, police-worn body cameras have never definitively reduced the frequency or intensity of police violence. Recorded footage is generally not accessible to the public, and police administrators (including officers themselves) are afforded significant privileges in handling the preservation and distribution of such recordings. (Keep in mind that the world learned of George Floyd’s murder at the hands of Minneapolis police through the video recording of a courageous 17-year-old minor, while former Officer Derek Chauvin’s body cam footage was not released until well into his criminal trial 10 months later.) Further, increased distribution of body-worn cameras contributes to the enhancement of criminalizing surveillance technologies, exacerbates privacy concerns, and often significantly increases police personnel and budgets under the guise of reform. On the “Use of Force Policy” The proposed revision to the UCPD’s Use of Force policy weaponizes fantastically broad definitions of “active resistance” and “assaultive resistance” to police authority. As defined in the proposed policy, these terms allow for extraordinarily generous interpretations of “resistance” that retroactively justify police force, potentially including deadly or maiming police violence; for example, the category of “active resistance” includes any observation of a policed subject’s “bracing, tensed muscles,” while the definition of “extreme agitation” — “agitation so severe that the person can be dangerous to themselves or others” — is precisely the rationale used to justify numerous anti-Black police killings, including Ma’Khia Bryant, Laquan McDonald, and many others. Similarly, the definition of “non-compliance” allows police the widest possible latitude to make subjective judgments of “physical gestures, stances, and observable mannerisms.” Such inferences are entirely saturated by the ideological, symbolic and historical forces of anti-Blackness, racism, sexism, gender normativity, ableism and ageism. The Use of Force policy is thus a potentially devastating weapon of repression, intimidation and criminalization because the scope of its implementation remains almost entirely determined by the perceptions of police officers themselves. Section 803 states: “reasonableness of force will be judged from the perspective of an objectively reasonable officer in the same situation, based on the circumstances perceived by the officer at the time.” (Emphasis added.) It is necessary to raise fundamental questions over the institutional assumptions that enable and allegedly necessitate such policies, which are usually framed by administrators as existing for the protection of those who are being policed. Use of force protocols neither prevent nor curb anti-Black, racist, gendered and ableist police violence. To the contrary, these policies establish the bureaucratic and legal premises for ensuring that police threat, harm and fatality remain central to “campus safety” infrastructures. Abolishing Normalized Institutional Violence While there are other aspects of the University of California’s proposed policy that call for critical examination, these few examples reflect the need to collectively challenge the normalized conditions of institutional violence that crystallize in the enduring presence of the UC police force. The UCPD’s enormous infrastructure of privilege and power (budgetary, juridical, and otherwise) has toxified one of the world’s largest public universities for well over half a century. At a moment in which people worldwide are questioning the institution of policing, it is both possible and necessary to challenge the very existence of police on college and university campuses.
